Introduction. These terms (Storyblok AI Terms) are entered into between Storyblok and Customer and are incorporated into and form part of the terms of the Agreement in relation to any AI Features included within the Storyblok Services. By enabling, accessing, or using any of AI Features, Customer agrees to these Storyblok AI Terms. If not agreed otherwise, the Storyblok GTC for enterprise customers in the Americas region or the Storyblok GTC for global self-service customers & enterprise customers for all other regions apply. In the event of any conflict between these Storyblok AI Terms and the Storyblok GTC, these Storyblok AI Terms prevail.

AI Features. AI Features means the features and capabilities integrated into the Storyblok Services powered by generative artificial intelligence and similar technology (AI) such as text generation, modification, translation, suggestion, or analysis, alt-text generation, SEO description, brand guidelines etc. via AI. The specific AI Features available may vary depending on the chosen Storyblok subscription. The AI Features process Customer-provided Input (meaning data provided by Customer which is processed by the AI Features) to generate Output (meaning all content or results generated by the AI Features based on the Input) using AI models and technology of third party service providers, referred to as AI Providers. For the sake of clarity, Storyblok may offer the option for certain Customers to also connect their own AI provider to the Storyblok Services. In such cases AI services are solely provided by the Customer’s chosen AI provider under a direct agreement between the Customer and that AI provider. The Customer is solely responsible for: (i) selecting and licensing its AI provider, (ii) maintaining credentials, configuration, and compliance with its provider’s applicable terms and licensing restrictions; (iii) all Input, Output, and related data processed through that provider; and (iv) verifying, reviewing and scrutinizing the operation, availability, or security and lawful data handling or processing of the AI provider. AI functionality or features provided by Customer’s own AI provider are not considered AI Features under these Storyblok AI Terms.

Deactivation. Customer may disable AI Features at any time in its Storyblok account settings. Disabling prevents (further) data from being shared with AI Providers.

AI Credits & Pricing. AI Feature usage is not unlimited. The Storyblok subscription plans may include different quotas of “AI Credits” which allow Customer to use the AI Features. Depending on Customer’s prompts, the chosen AI Provider and/or AI model AI Credit consumption may vary.  AI Credits are units of access or usage credits that may be issued by Storyblok to enable Customer to access and use certain AI Features. AI Credits have no cash value, and cannot be purchased, sold, transferred, bartered, or assigned in any way. AI Credits may only be redeemed for use of AI Features provided within the Storyblok Services. AI Credits are not refundable. For Self-Service Customers: Unconsumed AI Credits will be forfeited at the end of each contract month; no roll-over is possible. For Enterprise Customers: Unconsumed AI Credits will be forfeited at the end of each contract year. In case a Storyblok Services subscription expires or is terminated, AI Credits must be redeemed by the termination date, or else AI Credits will be forfeited. Customer is not entitled to compensation from Storyblok or its affiliates for AI Credits that are forfeited due to Customer’s Account suspension. Usage of AI Features over the included quota will result in additional charges for additional AI Credit packages. 

Ownership & Rights. As between Storyblok and Customer, Customer retains ownership of Input. Input is only used for the sole purpose of generating Output in response to prompts and requests made by Customer. Input is not used to train AI Features or the underlying AI provided by the AI Providers. Storyblok does not claim any ownership of Output. Due to the nature of generative AI, Output may not be unique and the same or similar output may also be provided to any third party. Output and responses received by other customers or users of Storyblok or the AI provider (even if the same as or similar to Output) are not Customer’s Output.

Personal Data. If Customer includes personal data, as defined by applicable data protection laws in the Input, Customer acknowledges and agrees that such Input is being processed by the AI Providers and being transferred to countries where the AI Providers operate, store, and process the Input for the purpose of generating Output. Customer is solely responsible for ensuring that its use of AI Features and Input complies with applicable data protection law. For further details please see the Storyblok DPA.

Changes. Storyblok may at any time modify or discontinue the AI Features, including AI Providers, AI Credits and pricing. Storyblok is not obliged to provide any maintenance, technical or other support for AI Features. Storyblok reserves the right to make AI Features or parts of it previously made available free of charge only under its paid subscription plans, or subject to additional payments. Storyblok reserves the right to make AI Features or parts of it available only within specific Storyblok subscriptions.

Customer Responsibilities. Customer is solely responsible for selecting what Input to provide to the AI Features. Customer agrees to not include any sensitive data (including but not limited to data about religious beliefs, ethnic origin, sexual orientation, etc.) within Input. Customer acknowledges that Input can be deleted at any time and assumes sole responsibility for any data backup. AI Features may generate inaccurate, false, incomplete, unreliable or offensive content. Use of Output is at Customer’s sole risk. Customer must review, verify, approve and evaluate the accuracy, quality, completeness, reliability, non-infringement and suitability for the intended purpose of all Output before use or publication. Customer must ensure appropriate human oversight before relying on, using or publishing any Output. Customer is solely responsible for ensuring that its use of the AI Features and Output complies with these Storyblok AI Terms, AI Provider’s policies & terms, applicable law, and third-party rights. Prior to publication, distribution, or external use of Output, Storyblok recommends that Customer clearly discloses to end-users or audiences that the relevant Output was generated or assisted by AI in a way no user or audience could reasonably miss or misunderstand.

Customer Indemnification. Customer shall, at Customer’s own expense, defend or, at Storyblok’s option, settle any claim or suit relating to the Input or Output brought against Storyblok, or the AI Providers, by a third party on the basis of infringement of their intellectual property rights or other rights in any Input or Output.

Disclaimer of Warranty. AI FEATURES ARE EXPERIMENTAL TECHNOLOGY. AI FEATURES ARE PROVIDED “AS-IS” WITHOUT WARRANTY OF ANY KIND. STORYBLOK DOES NOT MAKE ANY REPRESENTATIONS OR GIVES WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, IN RELATION TO AI FEATURES, ANY FUNCTIONS OR QUALITIES OF THE AI FEATURES, ANY INPUT OR OUTPUT. IN PARTICULAR, STORYBLOK DOES NOT WARRANT THAT THE AI FEATURES WILL BE AVAILABLE, PERMANENTLY AVAILABLE, UNINTERRUPTED OR ERROR FREE OR. NO WARRANTY IS GIVEN FOR THE ACCURACY, AVAILABILITY, SUITABILITY, RELIABILITY, OR CONTENT OF THE INPUT OR OUTPUT. OUTPUT MAY BE INACCURATE, INCOMPLETE, UNRELIABLE OR INAPPROPRIATE. OUTPUT IS NOT GUARANTEED TO BE FREE OF THIRD-PARTY RIGHTS.

Liability. Storyblok shall be liable for the AI Features in accordance with the liability provisions set forth in the Storyblok GTC for enterprise customers in the Americas region or the Storyblok GTC for global self-service customers & enterprise customers for all other regions. 

AI Providers. Storyblok uses the following third party AI Providers to provide AI Features.  Storyblok may add, remove or replace AI Providers and update the list of AI Providers from time to time. Customer acknowledges and agrees that use of the AI Features is subject to each AI Provider’s own terms of service or use and any accompanying license restrictions.

AI Features provided by OpenAI are subject to OpenAI terms and policies  including, but not limited to: OpenAI Terms of Service, OpenAI Terms of Use, OpenAI Privacy Policy , OpenAI Sharing & Publication Policy, OpenAI Usage Policy, OpenAI API Data Usage Policy.
